HEALTH/HIP GUARANTEE
a) Seller guarantees that Puppy is in good health and has received age appropriate medical inoculations and care including de-worming. Seller will provide Buyer with a medical chart detailing treatment Puppy has received under Seller's care, and future care Seller feels is essential to Puppy's well-being.
b) Seller guarantees that Puppy will obtain a passing OFA hip rating (Excellent, Good, or Fair) and elbow rating (Clear) at the age of two years. Buyer agrees that the examination will be done and all X-rays will be submitted to OFA for evaluation in enough time to be able to expect results returned by the age of 30 months. Failure to do so voids all hip and elbow guarantees. A copy of OFA hip/elbow certifications must be forwarded to Seller. It is understood that hip or elbow problems can occur within the best of breedings and that unless it will or does adversely affect the life and health of the puppy it will be accepted as a known risk of any dog purchased. Radiographic evidence with no symptoms is known to be possible, and will not always affect a dog.
c) Should Puppy be diagnosed with a hip or elbow disorder at the age of two, which is attested to by an Orthopedic Veterinarian and OFA at Buyers cost, Seller will, upon evidence of veterinary and Orthopedic Foundation for Animals (OFA) reports provided at the Buyers expense to the Seller, Seller will provide Buyer with the following option: Buyer may keep Puppy and accept a replacement puppy of similar quality. Buyer must pay any shipping or miscellaneous charges associated with transport of replacement puppy. Original Puppy must be spayed or neutered and spay/neuter certificate must be provided to Seller before replacement will be made. Seller will provide a replacement puppy of equivalent quality as soon as such a puppy is available to Seller. If there is a price difference between puppy to be replaced and replacement puppy, Buyer assumes responsibility for the price difference.
d) The breeder will only guarantee genetic hip dysplasia. Later development of hip dysplasia is not guaranteed, as this is often environmentally produced. Young dogs or pups involved in fast running, exercise on hard unyielding surfaces, climbing flights of stairs, jumping over or off of things can develop hip dysplasia. Also obesity, nutritional deficiency, injury, abuse, or premature stress on the joints due to jumping or climbing will nullify the hip guarantee.
e) This guarantee on replacement is good, within the limitations set forth in this contract, until Puppy reaches the age of 30 months. If Buyer transfers or sells the Puppy all such guarantees shall be void, and be considered as a contract only between the Seller and Buyer and shall not transfer to a new owner.
f) In the event that a bitch conceives a litter or a male sires a litter before the age of 24 months, this guarantee becomes null and void.
g) Seller shall not be held responsible for the development of disqualifying faults, disorders or diseases including diseases derived from stress associated with the departure of the litter.
h) Seller warrants the puppy until 12 months to be free of genetic disease that would cause severe disability or death. A replacement puppy of similar quality will be offered as soon as one becomes available as in 5.c above.
i) Any male pup without both testicles by one year should be neutered at the Buyers expense unless Puppy was purchased expressly for breeding purposes.
